Tivicay (dolutegravir): The 2029 Generic Opportunity Window

Tivicay (dolutegravir): The 2029 Generic Opportunity Window

Tivicay (dolutegravir), ViiV Healthcare's HIV-1 integrase inhibitor (majority-owned by GSK, with Pfizer and Shionogi as minority co-owners), anchors a franchise -- including the combination products Triumeq, Dovato, and Juluca -- that generated $5.65 billion for GSK in 2025. Its composition-of-matter patent expires October 5, 2027, but the practically-controlling barrier to US generic entry is a separate crystal-form patent, US 9,242,986, Orange Book-listed for Tivicay and expiring December 8, 2029. No FDA-approved generic dolutegravir tablet exists in the US today; Aurobindo Pharma and Strides Pharma hold only tentative approvals under the FDA's PEPFAR pathway, permitting supply to PEPFAR-designated countries but not US commercial sale. Real Paragraph IV challenges filed in 2017 by Cipla, Dr. Reddy's Laboratories, and Lupin (among others) against the crystal-form patent have since been settled, including the Hetero USA/Hetero Labs consent judgment closed December 2024 -- clearing the legal path without yet opening the market. One industry estimate places the earliest realistic US generic launch around mid-2030, accounting for post-expiry regulatory steps, though no exact date is confirmed via a primary source. One further sign of the patent's reach: Gilead pays ViiV a 3% royalty on US sales of its own rival HIV drug, Biktarvy, until the same October 2027 date, as part of a $1.25 billion settlement.
