Otsuka Replaced a Propoxy Linker with Butoxy on Aripiprazole. The Federal Circuit Held Hindsight Cannot Overcome Toxicity of Prior Art.
Otsuka Pharmaceutical Co., Ltd. v. Sandoz, Inc.

In Otsuka Pharmaceutical Co., Ltd. v. Sandoz, Inc., 678 F.3d 1280 (Fed. Cir. 2012), the U.S. Court of Appeals for the Federal Circuit affirmed that the claims covering aripiprazole (Abilify) were not invalid for obviousness. Aripiprazole, a blockbuster atypical antipsychotic, was designed by modifying a prior art prototype, OPC-4392.

The structural modifications involved replacing a propoxy (three-carbon) linker with a butoxy (four-carbon) linker, substituting a 2,3-dimethyl phenyl ring with a 2,3-dichloro phenyl ring, and utilizing a 3,4-dihydrocarbostyril core rather than a standard carbostyril. Generic challengers argued that these modifications were obvious. However, the Federal Circuit fundamentally rejected this as impermissible hindsight.

Crucially, the prior art taught that OPC-4392 caused unacceptable agitation and toxicity in clinical testing. The court held that a person of ordinary skill in the art would not select a compound known to be toxic as a "lead compound" for further antipsychotic development. Without a valid lead compound, and without motivation in the prior art to make those exact structural changes with a reasonable expectation of success, the obviousness attack failed. This case remains a bedrock precedent demonstrating that an inventor's successful path cannot be used retroactively as a blueprint to destroy their patent.

What we do

See if this applies to one of your matters

We run genus/species (Markush) claim coverage analysis, Section 3(d) compliance screening, and prior-art structural triage on real chemical structures: not keyword search. If a case like this one is live for you, we'll run a free sample on a compound of your choosing.
